End User License Agreement (EULA)

Effective Date: April 20, 2026

This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “you”) and Tide Networks LLC (“Company,” “we,” “us,” or “our”) governing your use of our software, including but not limited to the Tide Networks Agent, Remote Viewer, and any related applications, updates, and services (collectively, the “Software”).

By installing, accessing, or using the Software, you agree to be bound by this Agreement.

1. License Grant

Subject to your compliance with this Agreement, Tide Networks LLC grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Install and use the Software solely for your internal business or personal use
  • Use the Software only in accordance with its intended purpose

No ownership rights are transferred under this Agreement.

2. Restrictions

You agree NOT to:

  • Reverse engineer, decompile, or disassemble the Software
  • Modify, adapt, or create derivative works
  • Resell, sublicense, lease, or distribute the Software without written authorization
  • Use the Software to violate any laws or regulations
  • Attempt to gain unauthorized access to systems, networks, or data

3. Remote Access and Monitoring

The Software may allow remote system access, monitoring, automation, and administrative control.

By using the Software, you acknowledge and agree:

  • You are responsible for obtaining proper authorization before accessing any system
  • You assume full responsibility for any actions executed through the Software
  • Tide Networks is not responsible for misuse, unauthorized access, or damages resulting from your use

4. Data and Privacy

The Software may collect and process certain data, including:

  • System information
  • Device identifiers
  • Usage logs
  • Configuration data

You agree that:

  • This data may be used to operate, maintain, and improve the Software
  • You are responsible for ensuring your use complies with applicable privacy laws

5. Updates and Changes

We may:

  • Provide updates, patches, or new features
  • Modify or discontinue features at any time without notice

Continued use of the Software after updates constitutes acceptance of those changes.

6. Third-Party Components

The Software may include or integrate with third-party services or components.

  • Those components are subject to their own licensing terms
  • Tide Networks is not responsible for third-party software performance or security

7. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

We do not guarantee that:

  • The Software will be uninterrupted or error-free
  • The Software will meet your specific requirements

8. Limitation of Liability

To the maximum extent permitted by law:

Tide Networks LLC shall NOT be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, revenue, or business
  • System failures or downtime
  • Unauthorized access or security breaches

Total liability, if any, shall not exceed the amount paid (if any) for the Software.

9. Indemnification

You agree to indemnify and hold harmless Tide Networks LLC from any claims, damages, or liabilities arising from:

  • Your use of the Software
  • Your violation of this Agreement
  • Unauthorized or improper system access

10. Termination

This Agreement is effective until terminated.

We may terminate or suspend your access if you:

  • Violate this Agreement
  • Use the Software in a harmful or unlawful manner

Upon termination, you must:

  • Stop using the Software
  • Remove all copies in your possession

11. Governing Law

This Agreement shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

12. Entire Agreement

This Agreement constitutes the entire agreement between you and Tide Networks LLC regarding the Software and supersedes all prior agreements.

14. Security Responsibility

You are solely responsible for:

  • Securing access credentials, API keys, and enrollment tokens
  • Managing endpoint access and permissions
  • Monitoring activity performed through the Software

Tide Networks LLC is not responsible for any damages resulting from compromised credentials or improper configuration.
